GENERAL TERMS AND CONDITIONS OF SALE

1. Purpose and scope

These General Terms and Conditions of Sale (hereinafter "GTC") define the rights and obligations of Colitri Inc. and any individual or professional customer (hereinafter "the Customer") in the context of the sale of products offered on the site www.colitriaero.com (hereinafter "the Site").

Any order placed on the Site implies unconditional acceptance of these GTC, which prevail over any other document or condition issued by the Customer, unless otherwise agreed in writing by Colitri Inc.

Colitri Inc. is registered in the Quebec business register and is engaged in the design, manufacturing, and marketing of accessories for cycling and triathlon.

Colitri Inc. is a Canadian company specializing in the design and manufacture of innovative products for triathlon, operating through the official sitewww.colitriaero.com.

3. Products

The products offered for sale are those presented on the Site at the time of the order.

 They include the HydroFlow and HydroFlow Torpedo models for all our models, which can be accompanied by accessories or complementary items.

The essential characteristics of the products are described on the corresponding product sheets.

Colitri Inc. reserves the right to modify the technical characteristics, content, prices, or availability of the products without notice.

Unless otherwise stated, the products are manufactured and shipped from Canada.

4. Orders

Orders are placed exclusively through the Site.

The customer guarantees that they have the legal capacity to contract and are at least 18 years old.

Any order implies acceptance of the prices and descriptions of the available products.

The order is firm and final upon payment confirmation.

Colitri Inc. reserves the right to cancel any order in case of non-payment, incorrect address, or issues with the Customer's account.

5. Prices and Taxes

Prices are indicated excluding taxes (HT) and may vary depending on the Customer's location and the selected currency.

The total amount, including taxes and shipping fees, is indicated at the time of cart validation.

Colitri Inc. may change its prices at any time without notice; products are billed based on the rates in effect at the time the order is placed.

6. Payment

Payment is required in full at the time of the order.

Payment is made online by credit card via Stripe or PayPal.

No deferred or installment payments are accepted.

The order is processed only after payment confirmation.

7. Manufacturing, Shipping, and Delivery

Products are made to order. A preparation time of 2 to 5 business days may apply before shipping.

Shipping is handled by third-party carriers (DHL, UPS, Canada Post, FedEx).

Delivery times are generally 2 to 6 business days depending on the destination.

Colitri Inc. is not responsible for delays caused by the carrier.

In case of loss or damage during transport, Colitri Inc. assumes responsibility until effective delivery and will take the necessary measures to reship the product or proceed with a refund.

8. Transfer of ownership and transfer of risks

The transfer of ownership occurs after full payment of the price by the Customer.

The risks related to the loss or damage of the products are transferred to the Customer at the time of delivery.

9. Withdrawal, returns, and warranty

Returns are possible within a period of 14 days after purchase.

The item must be unused, undamaged and returned in its original packaging.

Photos of the product in question may be requested if the reason for the return is related to a damaged or broken package.

Colitri Inc. reserves the right to approve or deny the return after reviewing the request.

The products come with a commercial warranty of 2 years against any manufacturing defects.

Any misuse, incorrect installation, or use not in accordance with the intended purpose of the product excludes Colitri Inc.'s liability.

It is mandatory to disassemble the HydroFlow for any transport.

Colitri Inc. shall not be held responsible for any degradation or damage resulting from non-compliance with this instruction.

10. Replacement of an adjustment part (HydroFlow)

As part of the purchase of a HydroFlow product or one of its variants, the Customer may benefit from a free replacement (excluding shipping costs) of an adjustment part (BridgeFit, AngleFit, or CageFit).

This offer is valid only once per order, for a maximum period of one (1) year from the date of purchase, and only in the case where the Customer modifies the configuration of their cockpit after receiving the product.

Colitri Inc. reserves the right to request any information or documentation necessary to validate the request.

11. Liability and limitations

Colitri Inc. cannot be held responsible for any indirect, incidental, or consequential damages resulting from the use of the products.

Colitri Inc.'s liability is limited, in any case, to the amount of the order in question.

12. Intellectual property

All elements present on the Site (texts, images, logos, brands, models, designs, etc.) are protected by intellectual property rights belonging to Colitri Inc.

Any reproduction, representation, exploitation, adaptation, or use, in whole or in part, without prior written permission is strictly prohibited.

13. Applicable law and competent jurisdiction

These General Terms and Conditions are governed by the laws in force in the province of Quebec (Canada).

Any dispute will be submitted to the competent courts of the judicial district of Montreal (Quebec, Canada).
